Consent-based rape legislation

Consent-based rape law can strengthen human rights in rape cases, but that it is crucial that the law be drafted sufficiently clearly.

Recently, there have been political discussions in Parliament and debate in the media about the need for a new rape legislation, which is based on a requirement for consent. Denmark today lives up to the obligation to investigate and prosecute sexual crimes, but consent-based rape legislation will nevertheless be a positive human-rights move.

In this policy brief, the Institute of Human Rights's assessment of the human rights aspects of consent-based rape legislation is presented.
