The right to education

When children with disabilities do not go to school

In this report, the Institute for Human Rights focuses on the regulatory framework, which regulates school welfare cases, and analyzes whether the child's rights are guaranteed when the child is unable to attend school.

The right to education is a fundamental human right, and it is therefore crucial that the law ensures, as far as possible, the fulfillment of the child's human rights.

The study focuses on cases of children with autism spectrum disorders (hereinafter autism) and / or ADHD, as this group in the encounter with the educational environment in the primary school can lead to worsening of the child's well-being. This may mean that the child is at home for long periods without teaching.

This report is in Danish but contains an English summary on page 10.
